Terms and Conditions




These Terms & Conditions ("Terms" or "Terms & Conditions") are a contract between you and TrackYourStats.com. and applies to your use of the TrackYourStats.com Service ("Service"). In this Agreement, "you" or "your" means any person or entity using the Service ("Users"). Unless otherwise stated, "TrackYourStats.com", "we" or "our" will refer collectively to TrackYourStats.com. and its directors, officers, employees. By signing up for an account or using the Service you agree to the Terms. You further agree that these Terms form a legally binding contract between you and TrackYourStats.com, and that this agreement constitutes "a writing signed by You" under any applicable law or regulation. Any rights not expressly granted herein are reserved by TrackYourStats.com. These Terms are subject to change by TrackYourStats.com without prior notice (unless prior notice is required by law), by posting of the revised Terms on the TrackYourStats.com website.

Use of Service In General:
  • You will not attempt to cheat our service in any way.

  • You may not use the TrackYourStats.com service on any website that contains illegal content.

  • WE DO NOT GUARANTEE THE AVAILABILITY OF THE TRACKYOURSTATS.COM SERVICES. YOU AGREE NOT TO HOLD US RESPONSIBLE FOR DATA LOSS OR INTERRUPTION OF SERVICE OF ANY KIND.

  • You agree that any personal information you enter into the TrackYourStats.com system is true, accurate, complete and up to date. You will promptly update your information as applicable.

  • You are responsible for maintaining the confidentiality of your account, account information, password and for restricting access to your computer and you agree to accept responsibility for all activities that occur under your account or password.

Use of Free Service:
  • The TrackYourStats.com service is designed to replace your current top referrers list so you have to put the top referrer list on your main page not a secondary links page. You can however put the top referrers list on a secondary links page, IF the list is also on your main page.
    If the list doesn't appear on your site within 1 to 2 weeks we reserve the right to cancel your account.

  • We can cancel your account for any reason at any time.

  • If your account is inactive (you have not logged in or are not using the counter) for a continuous period of 90 days your account will be cancelled. You can re-apply for an account if you need the Service again.

  • The Tracker code (the T symbol) has to be copied into the source of your page INTEGRALLY AND WITHOUT ANY CHANGES. Only then the tracking will be accurate. If you change the code we reserve the right to suspend services. The image connected to the code must be placed in a VISIBLE way on your page and in the original size.

  • You understand that when using the free service both the top referrer links and the thumbnails links have sponsor advertising. This means a small percentage of the time when a surfer clicks on a link our sponsor page will open in a new window.

Use of Paid Service:
The restrictions of the Free Service do not apply to the Paid Service.
  • Pricing:
    The paid version of the TrackYourStats.com Service has the following pricing structure:
    • $5 per month for a maximum of 2 sites or 20,000 hits per day.
    • $10 per month for a maximum of 5 sites or 100,000 hits per day.
    If your sites will not be sufficiently satisfied by one of the pricing models above please contact us to negotiate a specific pricing arrangement for your sites.

  • Refund Policy:
    If you are not satisfied with the Service, and you contact us within 7 days of your initial purchase you will receive a refund to your credit card or Paypal account.
    If you are not satisfied with the Service, and you contact us after 7 days of your inital purchase we will look into your complaint and determine whether a refund is warranted.

  • Security:
    Your credit card information is stored using industry standard encryption and is sent over the Internet on a secure SSL connection. The database and website for TrackYourStats.com is located in a physically secure building and is monitored 24/7.

  • You agree that you are the rightful owner of any credit card information you enter into the TrackYourStats.com system and you agree that you have authorization to use that information.

Privacy Policy:
Any information you enter into the TrackYourStats.com system will not be sold or given to any third party other than to process transactions on your credit card.
You agree to receive periodic updates about current details of TrackYourStats.com via email.
You can access our web site home page and browse our site without disclosing your personal data or using cookies.
We collect the personal data that you may volunteer while using our services.
We do not collect information about our visitors from other sources, such as public records or bodies, or private organisations.
We ensure that your personal data will not be disclosed to State institutions and authorities except if required by law or other regulation.



Disclaimer of Warranties and Limitation of Liability:
THIS SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES THAT THE SERVICE IS FREE OF DEFECTS, MERCHANTABLE, RELIABLE, FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING. TRACKYOURSTATS.COM ASSUMES NO RISK AS TO THE QUALITY AND PERFORMANCE OF THE SERVICE. SHOULD THE SERVICE PROVE DEFECTIVE IN ANY RESPECT, TRACKYOURSTATS.COM ASSUMES NO COST OR LIABILITY FOR ANY SERVICING, DOWNTIME (OURS OR YOURS), DATA LOSS, REPAIR OR CORRECTION. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF THE SERVICE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.

TRACKYOURSTATS.COM EXPRESSLY DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. TRACKYOURSTATS.COM DISCLAIMS ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE SERVICE. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

TrackYourStats.com is not responsible for the content of any website using it's service.

If any provision of this Agreement is held to be illegal or unenforceable, then such section shall be eliminated or limited to the minimum extent necessary and the remainder (including any revised portion of the agreement) shall remain and have full force and effect.


Indemnification:
You agree to indemnify and hold TrackYourStats.com, it's officers, directors, and employees harmless from any claim or demand made or incurred by any third party due to or arising out of a breach of this agreement or your violation of any law or of any rights held by a third party relating to your use of the TrackYourStats.com service.


Trademarks:
TrackYourStats.com, TrackYourStats, Track Your Stats, and all related logos, products and services described on this website are trademarks of TrackYourStats.com.


Electronic Communications:
You consent to receive electronic communications from us via our website or email. You agree that all notices, agreements, disclosures and other communications that we provide to you electronically satisfy any legal requirements that those communications be in writing.

All content, software and digital media included on this site are property of TrackYourStats.com. or a business or person who has given TrackYourStats.com permission to display such content, software or digital media and is protected by Canadian and International copyright laws. Applicable Law:
